Personal Data Protection Policy

The Colombian Political Constitution establishes the right of all persons to know, update and rectify the information that exists about them in databases or files of public or private entities. It also orders those who have Personal Data of third parties to respect the rights and guarantees provided for in the Constitution when collecting, processing and circulating this type of information.
Likewise, the Colombian Political Constitution enshrines the right of any person to information, so that they receive truthful and impartial information.
Creaciones Angelita is committed to complying with the regulations on the protection of Personal Data and to respecting the rights of the Data Subjects. For this reason, it adopts this Personal Data Processing Policy, which is mandatory for all activities involving the Processing of Personal Data and is mandatory for the Company, its Administrators, Collaborators and third parties with whom it has contractual or commercial relationships.
The processing of personal data may be carried out through physical, automated or digital means according to the type and form of information collection.
Creaciones Angelita may use personal data to:
- Execute the existing contractual relationship with its clients, suppliers and employees, including the payment of contractual obligations and the exercise of rights derived therefrom.
- Provide the services and/or products required by its users.
- To inform about new products or services and/or changes to them.
- Evaluate the quality of service.
- Conduct internal studies on consumer habits.
- Send to the physical, electronic, cell phone or mobile device, via text messages (SMS and/or MMS) or through any other analogous and/or digital means of communication created or to be created, commercial, advertising or promotional information about the products and/or services, events and/or promotions of a commercial or non-commercial nature of these, in order to promote, invite, direct, execute, inform and in general, carry out campaigns, promotions or contests of a commercial or advertising nature, advanced by Creaciones Angelita and/or by third parties.
- Develop the selection, evaluation, and employment relationship process, as well as the processes required to fully comply with the employment relationship, including the granting of benefits.
- Support internal or external audit processes.
- Register the information of employees and/or pensioners (active and inactive) in the Creaciones Angelita databases
- Those indicated in the authorization granted by the data owner or described in the respective privacy notice, as the case may be.
- Provide, share, send or deliver your personal data to subsidiaries, affiliates or subordinate companies of Creaciones Angelita located in Colombia or any other country in the event that said companies require the information for the purposes indicated here.
- Provide your personal data to insurance companies when strictly necessary to cover the risks of Creaciones Angelita .
- Carry out marketing, sales and promotional activities, telemarketing (telephone marketing), customer service, brand activation activities, prizes and promotions, directly or through third parties derived from commercial alliances or any link.
- Implement relationship strategies with clients, suppliers, shareholders and other third parties with whom the Company has contractual or legal relationships;
- Make invitations to events, improve products and services or offer new products, and all those activities associated with the commercial relationship or existing link with Creaciones Angelita , or whatever he may have.
- Among others, without exceeding the limits of the law.
Authorization for Data Processing
We obtain the owner's authorization through any means that may be subject to subsequent consultation, such as the website, forms, formats, activities, face-to-face competitions, social networks, PQR formats, data messages or apps.
If personal data is provided, such information will be used only for the purposes stated herein, and therefore, Creaciones Angelita will not sell, license, transmit, or disclose it, except that:
- There is express authorization to do so.
- It is necessary to allow contractors or agents to provide the services commissioned.
- It is necessary in order to provide our services and/or products
- It is necessary to disclose it to entities that provide marketing services on behalf of Creaciones Angelita or to other entities with which joint marketing agreements are in place.
- The information relates to a merger, consolidation, acquisition, divestiture, or other corporate restructuring process.
- That is required or permitted by law.
Creaciones Angelita may subcontract third parties for the processing of certain functions or information.
When the processing of personal information is actually subcontracted to third parties or personal information is provided to third party service providers, Creaciones Angelita warns said third parties about the need to protect said personal information with appropriate security measures, the use of the information for their own purposes is prohibited and it is requested that they do not disclose the personal information to others.
Rights of personal data holders
Holders of personal data, either themselves or through their representative and/or agent or their successor in title, may exercise the following rights with respect to the personal data that are subject to processing by Creaciones Angelita :
- Right of access: By virtue of which you may access the personal data that is under the control of Creaciones Angelita , for the purpose of consulting them free of charge at least once each calendar month, and each time there are substantial modifications to the Information Processing Policies that motivate new consultations.
- Right to update, rectification and deletion: By virtue of which you may request the update, rectification and/or deletion of the personal data being processed, in such a way that the purposes of the processing are met.
- Right to request proof of authorization: except in events in which, according to current legal regulations, authorization is not required to carry out the treatment;
- Right to be informed about the use of personal data
- Right to file complaints with the Superintendency of Industry and Commerce : for violations of the provisions of current regulations on the processing of personal data.
- Right to require compliance with orders issued by the Superintendency of Industry and Commerce.
- For the purposes of exercising the rights described above, both the owner and the person representing him/her must prove their identity and, if applicable, the capacity by virtue of which they represent the owner. The rights of minors will be exercised through the persons who are authorized to represent them.

The market area of Angelita Creations will be responsible for addressing requests, complaints and claims made by the data owner in exercise, with the exception of those described in section e). Right to file complaints with the Superintendence of Industry and Commerce.
For such purposes, the owner of the personal data or the person representing him/her may send his/her request, complaint or claim from Monday to Friday from 8:00 a.m. to 6:00 p.m.

How many days will it take to receive my order?
Delivery time starts counting after confirming your payment. For national shipments it will be one (3) to five (8) business days. If you make your purchase on a Saturday, Sunday or holiday, it will be shipped the next business day.
How can I make a change?
To request a product exchange you must meet the following conditions:
- The maximum period to request a change will be sixty (30) calendar days counted from the date of delivery of the products.
- Accessories, tights and bodysuits cannot be exchanged.
- If it is a change of size or color, the customer must assume both shipping costs (return freight and reshipping freight of the package).
- Exchanges of products purchased on sale or promotion are not accepted.
IMPORTANT: The product must be in perfect condition, in its original packaging, with the original labels and accessories, and must not be used, washed, modified or altered. Items that do not meet the conditions listed above will be returned under the buyer's responsibility.
The change can be requested through any of the contact methods indicated below: WhatsApp 3203874355 informing the full name and information that you consider relevant to your request.
Creaciones Angelita will respond to your request within a period of no more than ten (10) business days.
For the purposes of requesting a change we recommend that you take into account:
- It is important to try on clothes before removing the tag.
- In accordance with the provisions of the applicable current regulations, for any changes made, Creaciones Angelita may charge a fee for the transportation service required for the return and delivery of the products to be exchanged, which will be announced at the time of responding to your request.
Once the change request has been made with the necessary data, the compliance with the requirements and the appropriateness of the change will be analyzed. If appropriate, the change will be sent.
Once we receive your product back at our warehouse, we will verify its condition. Creaciones Angelita will have 5 business days to inform you if your product meets the established criteria.
If your product does not meet the criteria of our exchange and return policy, we will inform you of the reason why the exchange is not valid and the product will be returned to the initial shipping address.
As a general rule, Creaciones Angelita does not refund money and if it is considered feasible, it will do so by issuing coupons equivalent to the purchase.
The times to formalize the change of products:
Exchange of approved product for size or color: it will be dispatched 5 business days after having analyzed compliance with the requirements. In any case, the delivery times of the product sent for exchange will be subject to the availability of said product within the inventory.
When, by virtue of the approved change, the issuance of an equivalent coupon to make a new purchase is agreed with the client, it must be through Instagram or WhatsApp, NOT through our website.
Do the garments have a guarantee?
The warranty period for quality defects is 30 days from the moment you receive the product. Customers should read the instructions for use and washing and the use and care labels very carefully.
CARE RECOMMENDATIONS:
Gentle hand wash. Avoid rubbing and bleaching. Use cold water and mild soap. Do not soak or wring. Do not use a washing machine or dryer. Dry in the shade.
The warranty does not cover normal deterioration of the product, improper use, or damage caused by failure to follow instructions for the care or maintenance of the products.
In the event of a warranty claim, we will analyze the claim and give you a response as to whether or not the claim is valid within a maximum period of 15 business days. If the item can be repaired, it will be repaired, otherwise it will be exchanged.
What is the status of my order?
We will update you via email on the status of your order, tracking number and logistics partner. We will also inform you when your payment is approved, when we are processing your order and when it is invoiced and shipped.
Retraction Policy
If you wish to withdraw your consent once you have received the product, you may do so as long as you comply with the following:
VALIDITY: This procedure may only be carried out during the first 5 business days following receipt of the package, in accordance with the right of withdrawal established by law 1480 art. 47.
CONDITION: It is essential to ensure the integrity of the product; the exchange or withdrawal process can only be initiated when the products show no signs of having been used, have intact labels, are in an impeccable state of cleanliness and the packaging and accessories are in perfect condition.
FREIGHT: Freight and insurance costs will be the responsibility of the customer and packaging must ensure that the product is received in perfect condition. It is the buyer's responsibility to take the necessary measures to ensure that the product, including its packaging, is not damaged during transport.
If all the conditions mentioned above are met, CREACIONES ANGELITA will return the total amount paid for the garments, without any discounts or deductions being made and the term may not exceed 30 calendar days.
